These terms govern your purchase and use of digital professional development courses (PDs) on PDMarketplace, a platform for independent vendors to sell digital content. By making a purchase, you agree to these terms. PDMarketplace reserves the right to refuse service to anyone for any reason at its discretion.

Refund Policy

  • Eligibility and Timeline: Our refund policy lasts 30 days from the date of purchase. Due to the digital nature of PDs, refunds are not available once a product has been accessed or downloaded, except in the following cases:
    • The PD is defective (e.g., the file won’t open, content is inaccessible).
    • The PD does not match the vendor’s description (e.g., significant discrepancies in content).
    • Refunds for defective or mismatched PDs will only be issued if the vendor cannot resolve the issue within a reasonable timeframe (typically 5 business days).
  • Non-Refundable Items: The following are non-refundable under any circumstances:
    • Gift cards.
    • PDs that have been accessed or downloaded, unless defective or mismatched as described above.
  • Refund Process: To request a refund, email support@pdmarketplace.com with your receipt or proof of purchase within 30 days of purchase. PDMarketplace will review the request, which may involve the vendor to resolve disputes (e.g., verifying defects). You agree to cooperate with PDMarketplace and the vendor in resolving refund requests. We’ll email you within 5 business days about the approval or rejection of your refund. Approved refunds will be processed to your original payment method within 10 business days.
  • Late or Missing Refunds: If you haven’t received an approved refund, check your bank/credit card account, then contact your provider, as processing times vary. If issues persist, email support@pdmarketplace.com.
  • Sale Items: Only regular-priced PDs are refundable; sale items are non-refundable.
  • Vendor Disputes: If a refund involves a dispute with the vendor (e.g., disagreement over defect claims), PDMarketplace’s decision is final. Refunds, if approved, will be deducted from the vendor’s earnings, as per our Vendor Terms.

Liability and Indemnification
You agree to indemnify, defend, and hold harmless PDMarketplace, its affiliates, employees, and partners from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your use of purchased PDs, violation of these terms, or misuse of the platform. PDMarketplace is not liable for any indirect, incidental, or consequential damages (e.g., loss of profits, data, or opportunities) related to your use of the platform, even if advised of such damages. PDMarketplace is not responsible for the quality, accuracy, or effectiveness of PDs, as vendors are solely responsible for their content.

Compliance with Laws
You are responsible for ensuring your use of PDMarketplace and purchased PDs complies with all applicable local, state, national, and international laws, including tax and consumer protection laws. PDMarketplace may request documentation to ensure compliance, and failure to provide it may result in account suspension.

Dispute Resolution
Any disputes arising from these terms or your use of PDMarketplace will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in [Your State], USA. You agree to waive your right to a jury trial or participate in a class action lawsuit. Each party will bear its own legal fees, unless otherwise determined by the arbitrator. This clause does not apply to disputes involving intellectual property claims, which may be resolved in a court of competent jurisdiction.

Account Security
You are responsible for maintaining the security of your PDMarketplace account, including your login credentials. PDMarketplace is not liable for unauthorized access due to your failure to secure your credentials. If you suspect a breach, notify us immediately at support@pdmarketplace.com.

Acceptable Use
You agree to use purchased PDs solely for personal or professional development purposes as intended. You may not resell, redistribute, or modify PDs without the vendor’s permission. Violation of this policy may result in account suspension and legal action.

Termination and Suspension
PDMarketplace reserves the right to suspend or terminate your account at its discretion, with or without notice, for reasons including violation of these terms, fraudulent activity, or misuse of PDs. Upon termination, you may lose access to purchased digital content, and no refunds will be issued for such content.

Changes to Terms
PDMarketplace reserves the right to update these terms at any time. Changes will be communicated via email or through the platform, and continued use of PDMarketplace after such changes constitutes your acceptance of the updated terms. If you do not agree, you may stop using the platform.

Returns and Replacement Policy

Overview

Replacements
If a digital PD is defective or does not match its description, email support@pdmarketplace.com within 30 days. We’ll work with the vendor to provide a replacement file within 5 business days. If the issue cannot be resolved, a refund may be issued at PDMarketplace’s discretion.

Gifts
If a PD was marked as a gift at purchase, you’ll receive a gift credit for the value upon an approved refund. A gift certificate will be emailed to you. If not marked as a gift, or the giver purchased it for themselves to give later, the refund will be issued to the gift giver.
